What are Executors?

If the person who has died has left a valid Will then the Will will probably name "executors". These are the people who have the responsibility to deal with someone's affairs after their death.

Do I need a Grant of probate?

If the deceased has left only a small amount of money then it may be possible for you to look after their affairs without obtaining a Grant of Probate. We suggest that you contact the bank and/or building society where your loved one held money for more information.

If the deceased left a property or significant assets then it is likely that a Grant of Probate will be required. This is itself can be a complicated process as you will need to do the following:

  1. Establish what assets and liabilities are in the estate.
  2. Is there any Inheritance Tax to be paid? If so this will need to be paid to HM Revenue & Customs.
  3. Only after any Inheritance Tax has been paid can you apply for a Grant of Probate. The application is sent to a section of the Court known as the Probate Registry.
  4. After you have received the Grant of Probate you will then have the right to access funds and pay any debts owing.
  5. You then need to ensure that assets ate shared out in accordance with the terms of the deceased's Will.
  6. Income tax affairs need to be finalised.
  7. Estate accounts need to be prepared.
